Terms & Conditions

Thank you for your interest in the Birs73 SUP Center Basel. By accepting your reservation at Birs73, a contract is created between you and Birs73 (hereinafter also referred to as the organizer). We therefore ask you to read the following general terms and conditions carefully.

TLDR:

With a reservation on birs73.ch/sup you accept the following terms and conditions:

Water sports involve certain risks.

We rent to safe swimmers only.

Vest must be carried.

Completed beginner course of advantage.

Insurance is the responsibility of the participants / tenants.

Birs73 disclaims all liability for damages arising from material, the participating person, third-party material or third parties.

1 Registration

Registrations are accepted exclusively online – telephone registrations are only accepted for short-term reservations on the same day. By registering, you acknowledge these terms and conditions as part of the contract between you and the organizer.

2 Subject of the contract

The Organizer undertakes to provide the service reserved by you for the activity offered by him in accordance with the descriptions in his brochure / website. Special requests can be considered against agreement with the organizer. Any additional costs will be borne by the customer.

3 Contract conclusion

By accepting your online reservation or by phone from the organizer or its outlets, a contract between you and Birs73 comes about. From then on, the rights and obligations under the contract will be effective for you and Birs73.

4 Prices

The prices for the activities you can see from the current prices on the website. They are per person or, if stated otherwise, per water sport device in Swiss Francs. Price changes are reserved.

5 Terms of payment

Payment is made in advance at the online reservation. For short-term bookings on the same day can be paid locally in cash or by card (no Postcard!). Groups of 15 people or more can request an invoice, which will be provided below.

6 Annulation by the customer

Your reservation is binding. Cancellation or postponement of the date by the customer must be made for renting: 24 hours and for tours and courses: 48 hours before the start of the reservation by phone, on the website or email to Birs73. If canceled outside of these deadlines, 100% of the costs will be retained or charged. In the case of no-shows without cancellation, the entire booking amount will automatically be deducted. If a shift of the date is not possible, Birs73 will issue vouchers for the total number of reserved water sports equipment and courses. These can also be redeemed individually at a later date (also possible in the following season).

Exceptions are prevention due to accidents or illnesses, for which Birs73 always issues vouchers upon deregistration.

7 Cancellation by the organizer

The activity may be canceled by the organizer if participants give reason to do so by their actions and omissions. In this case the customer will not be reimbursed any costs. If the activity is endangered by force majeure, weather and nature conditions, official measures or security risks (eg flood) or impossible, the organizer can cancel the activity or cancel it prematurely. The organizer can also cancel the activity in case there are not enough bookings for a class or tour. In this case, the customer can reserve a new date or receive vouchers

8 Termination of the activity by the customer

If the customer terminates the activity prematurely or if he leaves prematurely, he is not entitled to a refund. Any additional costs shall be borne by the customer.

9 Terms of participation

A good health and the ability to swim well is a prerequisite for all activities. The participant undertakes to inform the organizer of any health problems. Participation in an activity under the influence of drugs and alcohol, psychotropic drugs or the like is not allowed. It is the customer’s obligation to abide by the conditions of participation and to strictly follow the instructions of the organizer, the guides and the assistants. If these conditions of participation are not fulfilled by a participant or if he does not follow the instructions, the organizer reserves the right to exclude him from the activity. If the committee takes action after the start of the activity, the customer is not entitled to a refund.

10 Insurance and disclaimer

The participant is not insured by the organizer. The participant must have independently completed adequate health and accident insurance (including sports accidents). Despite expert and safe execution of the activity accidents can not be excluded. The organizer can not exercise any liability for this

11 Complaints

Complaints or any damage suffered must be reported in writing to the activity manager immediately and must be confirmed by the latter. However, the activity management is not authorized to recognize claims in the name of the organizer. He will endeavor to remedy the program and its possibilities. Claims for damages must be made in writing within four weeks after completion of the activity by registered letter to the organizer. The confirmation of the Head of Activity and any evidence must be attached to this letter. In the event of late submission of your claim or in the event of failure or late objection during the activity, all claims shall lapse.

12 Liability

The organizer shall be liable under these terms and conditions for any defect or failure in the performance of the activity that is inferior to the original agreement. The participant is entitled to compensation if there is fault on the part of the organizer or his assistant and no equivalent compensation could be provided on the spot. For other damages (not personal injury) the liability is limited to twice the travel price (per person). The organizer disclaims all liability for damages and disadvantages of any kind, which have come about through no fault of the organizer or his assistant. The organizer is liable for acts of the activity leader only if he acts culpably in the course of his activity as head of the activity. In case of faulty breakdown, the organizer can provide an equivalent replacement service within a reasonable period of time. In this case, claims for compensation are excluded.

13 Applicable law

All legal relationships between the customer and the organizer are subject to Swiss law. The relevant legal provisions apply. If these general provisions provide for stricter limitations of liability for the liability conditions, these will apply.

 14 Jurisdiction

The exclusive place of jurisdiction for all disputes arising from this contract is Birsfelden.
